国际法与国际关系双重视角下的联合国维持和平行动——评蒋圣力《联合国维持和平行动法律问题研究》

在当前国内外学界尚少有专门针对联合国维持和平行动中的法律问题开展深入具体的研究的情况下,《联合国维持和平行动法律问题研究》一书为填补这一领域研究的不足做出了有益的尝试。一方面,该书立足于国际法研究的视角,对联合国维持和平行动的法律概念、法律基础、基本原则以及违法情形的国内法和国际人道法责任进行了全方位的系统梳理和分析。另一方面,该书又从国际法与国际关系交叉研究的视角出发,对联合国维持和平行动的维和人员法律保障和中国对联合国维持和平行动的参与这两项重要议题进行了探索,提出了具有创见的认识和理解。从整体上看,该书所采用的研究思路、研究方法和所提出的观点、见解大都具有较强的创新性和独到性,对学理研究和实务操作均具有一定的参考和借鉴价值;同时,该书也存在若干不尽之处,有待进一步完善。

Under the circumstance that there is few specific researches around the legal issues on the U.N.peacekeeping operation in neither the foreign nor the domestic research field,the book "Legal Study on the U.N.Peacekeeping Operations" has made great effort to cover the shortage.On one side,under the view of international law,the book has thoroughly cleared and analyzed the legal concept,legal basis,basic principles,the domestic law and international humanitarian law liability for unlawful acts,of the U.N.peacekeeping operation.And on the other side,under the view of both international law and international relation,the book has worked on two essential practical issues of the U.N.peacekeeping operation,namely the legal protection for the peacekeepers,and the involvement of China in the U.N.peacekeeping operations.As a whole,the research approaches taken and the opinions raised by this book are properly innovative,and can be referential to both the theoretical study and practical operation.While,there are still quite a few shortages in this book,which should be further improved.
