An Analysis of the Path of Constitutional Review under the System of Peoples' Congress

推进合宪性审查工作,有助于树立我国宪法权威,加强我国宪法的实施和监督。由全国人大及其常委会的专门性机构宪法和法律委员会协助实施我国的合宪性审查工作,是党中央做出的一项重大决策,这也是我国保障宪法实施、促进宪法监督方面的重大进步。当前,推进合宪性审查工作面临着三大任务:破解全国人大及其常委会"自我审查"的理论困境;厘定合宪性审查的对象和范围;建立和完善宪法审查程序机制。

Advancing the work of Constitutional Review will help establish the authority of the Constitution.The implementation of Chinese Constitutional Review by the Constitutional and Legal Committee of the National People's Congress is a major decision made by the Party Central Committee.At present,the promotion of Constitutional Review is faced with three major tasks:to break the theoretical dilemma of the self-censorship,to determine the object and scope of Constitutional Review and to establish Constitutional Review procedures.
