农村集体土地建设租赁住房收益分配的思考 被引量:3

摘要 党的十九大报告指出,"三农"问题是关系国计民生的根本性问题,必须始终把解决好"三农"问题作为全党的重中之重。农民是"三农"问题的核心。2017年8月原国土资源部、住房城乡建设部联合印发了《利用集体建设用地建设租赁住房试点方案》,将北京、上海、沈阳、南京等13个城市作为第一批试点,利用集体建设用地开展租赁住房建设。目前,该方案在试点城市开展的项目建成入市的收益分配尤为重要。收益分配是在多方权益主体之间进行的,根据收益分配的形成,对各主体之间的分配关系进行分析。建立合理的收益分配机制,关系到"三农"问题的有效解决,对保障农民权益、增加农民收入、优化农村治理、维护社会稳定有着重要的意义。本文主要对农村集体土地建设租赁住房各权益主体的分配关系进行探讨分析,合理构建我国农村集体土地租赁住房收益分配机制。 The report of the 19th National Congress of the Communist Party of China pointed out that the issue of“agriculture,rural areas and farmers”is a fundamental issue concerning the national economy and the people's livelihood.It is imperative to always solve the“three rural issues”as the top priority of the whole party.Peasants are the core of the“three rural issues.”In August 2017,the former Ministry of Land and Resources and the Ministry of Housing and Urban-Rural Development jointly issued the“Pilot Program for Building Leased Housing by Collective Construction Land”,and 13 cities including Beijing,Shanghai,Shenyang and Nanjing were used as the first batch of pilot projects to utilize collective construction land.Carry out the construction of rental housing.At present,the program has been carried out in pilot cities,and the distribution of income from the completion of the project is particularly important.The income distribution is carried out among the multi-party equity entities.According to the formation of the income distribution,the distribution relationship between the entities is analyzed.Establishing a reasonable income distribution mechanism is related to the effective settlement of the“three rural issues”,which is of great significance for safeguarding farmers'rights and interests,increasing farmers'income,optimizing rural governance,and maintaining social stability.This paper mainly discusses the distribution relationship of the various equity entities in rural collective land construction leased housing,and rationally constructs the income distribution mechanism of rural collective land leasehold housing in China.
