摘要
在交通流量激增的背景下,仅靠正式警力难以有效展开城市交通治理。一方面,坚持某些由传统理论推演而来的"法治标准",绝对否定交通辅警的"独立警务",就无法发挥辅警疏缓警力不足的社会功能,创新法治观念及法律规范成为推进该领域社会治理的重要环节;另一方面,脱离我国辅警在整体素质、从业心态、培训水平等方面的现实状况,盲目引进域外模式过度放权,则会引发侵害公民权利的反法治效果。社会治理法治化既不是某些抽象、统一、宏大、普遍的传统法治理念或法学原理的当代展开,也不是西方法治模板的简单拷贝与移植。它应该是一个立足现实治理需求和民众实际利益,由政府、社会各方参与的,围绕具体问题具象性展开的建构过程。
Faced with the booming of the traffic flow, police force is insufficient for urban traffic governance. On one hand, the function of traffic auxiliary police to alleviate the lack of police force is hard to be fulfilled if we stick to the "legal standard" derived from traditional theories. Thus, innovative legal concept and legal norms play an important role in the promotion of social governance in this area. On the other hand, divorced from the reality of current traffic auxiliary police in China including general quality, mentality of career, the level of training of them, etc, thoughtlessly introducing "advanced", "mature" and "typical" foreign mode will lead to the over-devolution of the authority to traffic auxiliary police and the negative effects of infringement of the civil rights and impairment of social governance. Hence legalization of social governance is neither a contemporary realization of an abstract, general, great, and common traditional legal concept or principle, nor a simple copy and transplantation of the western legal mode. Instead, legalization of social governance is a construction progress involved by government and the general public where specific questions are to be discussed and real public benefits are to be pursued in response to the objective demand of social governance.
