地方政府行政权责清单制度构建研究——以广东省三个地级市部门权责清单为例

Research on the List System Construction of Local Governments’ Administrative Power and Responsibility:with Three Prefectural City Governments in Guangdong Province as Examples

监督制约公权力的前提条件和有效方式是构建权责清单制度,构建权责清单有利于公权力的具体化、程序化、透明化和法治化。通过对广东省G市、Z市和Q市公布的市级部门权责清单,特别以三地S局的部门权责清单的比较研究,发现当前三地权责清单存在职权细分不规范、职权的法规依据不一、审批对象各异、职权行使流程图差异大、职权责任事项不够明确、职权变相隐藏在“其它”类别中的问题,提出要进一步加强权责清单的标准化建设、程序化建设、法治化建设和数字化建设,强化权责配置的科学性和加强责任机制建设来促进地方政府行政权责清单制度的完善。

The construction of power and responsibility list system is the prerequisite and effective way to supervise and restrict public power,which is conducive to realizing a concrete,procedural,transparent and legitimate public power.A comparative study of the list of powers and responsibilities of S bureau of G,Z and Q cities in Guangdong province indicates that:the division of power is not standardized,the regulatory basis of the power,approval objects and authority exercise flow charts are different,the responsibilities and rights are not clear enough,part of the authority is hidden in the"Other"category.This paper proposes to promote the perfection of the list system of administrative powers and responsibilities for local governments through standardized,procedural,legitimate and digitized construction.
