论法律信仰的文化根基

On the Cultural Foundation of Legal Beliefs

建设法治国家是所有人共同的期待,依法治国不仅要制定良好完备的法律,更需要人人遵守法律。使人人遵守法律成为现实,既不能没有法律的强制力的支撑,又不能没有广大人民对法律的认可和信任。伯尔曼作为知名法学家曾强调:“法律一定要被民众信仰,不然它将会形同虚设。”基于此,在分析、对比东方和西方的法律信仰发展史的基础上,深入探究文化对法律信仰造成的影响,并提出相应措施。

Building a country under the rule of law is the common aspiration of all people.The rule of law requires not only the formulation of sound and complete laws,but also the observance of laws by all.To make it a reality for everyone to abide by the law,we cannot do so without the support of the law’s coercive force,nor without the people’s recognition and trust in the law.Berman,a noted jurist,once stressed:“the law must be believed by the people,or it will be worthless”.Based on this,this paper,on the basis of analyzing and comparing the development history of legal belief in the east and the west,probes into the influence of culture on legal belief and proposes corresponding measures.
