民法典物权编应当界定农民集体所有权的类型的本质属性,应将农民集体所有权界定为体现农民集体公有制的所有权类型。农民集体所有权是指农村社区农民集体的成员集体以保障本集体成员的生存和发展为目的,对属于本集体所有的土地及其他自然资源和财产依法管理和占有、使用、收益、处分,并使集体成员受益的权利。以此为基础,才能完善农民集体所有权制度。

The property rights compilation of the Civil Code should define the type of the collective ownership of the peasants.The collective ownership of the peasants should be defined as the type of ownership that reflects the collective public ownership of the peasants.The collective ownership of the peasants refers to rights of the collective members of the peasant collectives in the rural communities to guarantee their survival and development,including,for this purpose,the rights to manage and possess,use,profit from the land and other natural resources and property that belong to the collective.Only when these rights are clearly defined,can we improve the collective ownership system of farmers.
