A STUDY OF LEGISLATIVE PROMOTION OF SOCIAL JUSTICE IN THE NEW ERA

我国立法经过多年发展,在促进社会公正方面取得了一定的成就。进入新的历史时代以来,随着人们对社会公正更高的祈求,立法在促进社会公正方面也显示出一定的缺陷,这些缺陷对法治社会的建构具有消极作用。在新的历史时代,通过立法促进社会公正应当引起重视,立法行为应当契合社会变奏、整合社会治理、融入社会过程和解决社会问题。基于这样的精神,立法活动应当在促进社会公正方面沿着新的路径展开,包括立法中定性与定量的统一、奖励与惩戒的统一、规范与技术标准的统一、本土化与全球化的统一等。

China has seen years of legislative development and its achievements in promoting social justice. In the new era, with people’s growing expectation for social justice, legislation begins to show certain flaws in promoting social justice, which may have a negative effect on the construction of the society ruled by law. So due attention should be paid to the legislative promotion of social justice. Legislation should keep up with social changes, integrate with social governance, take part in social processes and solve social problems. On such basis, legislative activities should follow a new path in promoting social justice, for example, the integration of qualitative and quantitative methods in legislation, the combination of reward and punishment, the unification of technical norms and standards, and the integration of localization and globalization.
