摘要
随着信息技术的深入发展,人工智能在人类日常生活中的应用越来越广泛,所引发的法律问题也越来越多,诸如人工智能时代机器人是否拥有和人类一样的法律主体地位,侵犯人类的隐私如何处置,以及给他人造成侵害要如何归责,等等。民法的一个重要职能是调整社会关系,为了让法律可以更好地应对应人工智能时代的到来,从民事主体制度、个人隐私、侵权责任制度几个方面进行相应的研究必不可少。
Artificial intelligence have had more and more applications in human daily life with IT technology in-depth development, thus resulted in more and more legal problems such as if robots have the same legal subject status as human beings in the age of artificial intelligence, how to deal with the violation in human privacy and how to define imputation of infringement on others. One of important functions of civil law is adjusting social relations. In order to enable civil law to adapt to the arrival of the age of artificial intelligence, relevant research from such aspects as civil subject system, personal privacy and tort liability system.
