Analasis of Excessive Querying of “the Lack of Essential Technical Features”

在审查实践中,由于技术理解有偏差、过多代入说明书中更优实施例的内容或法条混淆等,会出现关于缺乏必要技术特征过度质疑的问题。本文以实际案例,分析了缺乏必要技术特征过度质疑的原因,并从立法本意和法条适用性层面上进行了缺必特法条和容易发生法条混淆的不支持法条的对比分析,给出了是否存在缺乏必要技术特征缺陷的一些判断标准,以期为审查过程提供参考帮助。

In the practice of examination,inaccurate interpretation of the technique,excessive attention of the better embodiment in the description and confusion of the law clause may lead to the case of excessive que.rying of the lack of essential technical features.Based on real cases,this paper analyses the reason that lead to this phenomenon,performs an comparative analysis between the law clause of“lack of essential technical fea.tures”and“lack of support”in the angel of applicability and original intent,and provides some criterions that can help to decide whether the defect of“lack of essential technical features”is existed.
