我国自由贸易区(港)的模式转变与法治一体建设

From “Legal Green Light” to “Legislation First”:The Model Transformation and Integration Construction of the Rule of Law of China's Free Trade Area(FTA)

上海自由贸易试验区建设过程中许多"先行先试"的制度安排和举措与现行法律、行政法规相冲突,被称之为"法律绿灯"模式;海南中国特色自由贸易港建设开启了"立法先行"的授权立法模式。海南自由贸易港授权立法模式是基于海南自由贸易港"整体推进、路径明晰、全岛建设、特区优势"的特点,强调通过党对立法工作的领导。依据我国《立法法》的相关规定,全国人大对海南经济特区(自由贸易港)进行立法授权而推进改革,真正落实"重大改革于法有据"。这种从"法律绿灯"到"立法先行"的转变,折射出我国推进自由贸易区(港)建设法治模式的变革和法治国家、法治政府、法治社会的一体建设,是全面依法治国的深入发展与鲜明写照。

This transformation from "legal green light" to "legislation first" reflects the transformation of China's rule of law model in promoting the construction of in the Free Trade area (port) and the integration construction of a state ruled by law, a government ruled by law, and a society ruled by law. It is the in-depth development and vivid portrayal of rule of law.
