人工智能在我国司法实践领域的推行与应用已成为一个不可逆转的趋势,这为我国司法实践整体性变革带来了全新机遇,主要体现为有助于提升司法效率,破解"案多人少"的司法治理难题;有助于实现实体公正,达至"类案类判"的司法裁判常态;有助于推进司法公开,进一步提高司法机关的公信力。与此同时,我国司法实践也面临着既有的司法数据现状无法有效满足司法智慧化的需要、算法的偏见与隐秘可能影响司法裁判的公正与公开、复合型人才的匮乏难以为司法智慧化提供足够的人力支持等现实挑战。因而有必要建立统一的现代化司法大数据库,构建完备的算法审查与公开机制,推行跨学科的复合型人才培养与培训模式。

The implementation and application of artificial intelligence in the field of judicial practice has become an irreversible trend in China, which has brought new opportunities for the overall reform. It mainly includes solving the predicament of judicial governance of fewer judges and more cases, helping to improve judicial efficiency, achieving substantive justice and reaching the normal judicial judgment of similar cases being treated similarly, and further enhancing the credibility of judicial authority for judicial openness. Meanwhile, the judicial practice is also facing practical challenges such as the existing judicial data fail to effectively meet the needs of judicial intellectualization, the bias and concealment of algorithms may affect the fairness and openness of judicial decisions and the lack of interdisciplinary talents is unable to provide enough human resources support for judicial intellectualization. Therefore, it is necessary to establish the unified modern judicial database, build the complete review and public mechanism for algorithms and implement the interdisciplinary talents training model.
