摘要
网约车模式是共享经济模式的重要组成部分,具有精确性、灵活性和便捷性的特征。该模式发展势头强劲、前景广阔,但也存在不少问题,如竞争无序、规制失灵、消费者权益受损等。基于规制绩效和规制可行性考量,网约车模式法律规制的重点对象应当是网约车平台公司,对网约车司机的规制应更多依赖于网约车平台的自律监管和行业规制。由此需要对其法律规制路径进行优化:在竞争法视阈下进行差异化规制,在审慎监管下将严厉性规制与灵活性规制相结合,在纳什均衡与执法金字塔理论指导下创新阶梯式公私合作规制路径。
The model of online car appointment has a strong momentum of development and a broad prospect. However, it is not to overstate its social benefits. The problems arising from the online car appointment model are rooted in disorderly competition, regulatory failure and consumer rights under average. Based on the consideration of regulatory performance and regulatory feasibility, the key object of legal regulation should be the company of online car-sharing platform, and the regulation of online car-sharing driver should rely more on the self-regulation and industry rules. Reconstructing the legal regulation path is as follows: the differentiation of legal regulation under the perspective of competition law, the combination of strictness and flexibility regula.tion under prudential supervision, innovative regulation of ladder public-private partnership under the theory of law enforcement Pyramid and Nash equilibrium theory.
