摘要
超时工作具有普遍性、制度性、文化性和违法性等主要特点,使劳动者透支身心健康、不利于学习提高,也无益于企业效益的增加,还具有不容忽视的社会危害。从目前劳动法制度看,超时工作的成因有工作时间界定不清、工时法律规制僵化、过劳损害认定困难、违法追究力度有限等方面。因此,治理超时工作,需要完善现有工时界定,探索新型工作模式,并完善“过劳死”预防规制,加强违法责任追究,从而优化现有劳动法制度。
The phenomenon of overtime work possesses universal, institutional, cultural and illegal feature. It overdrafts laborers' physical and mental health, hinders the improvement of laborers, and harms the enterprise efficiency. It is also harmful to society which cannot be ignored. Judging from the current labor law system, the causes of overtime work include unclear definition of working hours, rigid legal regulation of working hours, difficulty in identifying overwork damages, and limited efforts made to investigate violations of the law. Therefore, to solve the problem of overtime work, it is necessary to perfect the definition of existing working hours, explore new working modes, improve the Karoshi prevention regulation, and strengthen the investigation of illegal liability. Thus the existing labor law system can be optimized.
