我国生态保护红线归责机制的完善

The perfection of the liability imputation Mechanism of the Red Line of Ecological Protection in China

生态保护红线是我国近年来在环境保护领域提出的一项突破性的制度。2014年我国颁布新修订的《中华人民共和国环境保护法》,明确提出了这一概念。可以肯定的是这是我国在生态环境立法上的一个进步,表明了我国运用法律手段保护生态环境的决心。然而,目前虽然有了这一制度的概念,但是在实际的运行中仍然存在诸多问题,目前如何实现这项制度的细化以及明确相应的法律责任是实现生态系统管理的重要一步。本文通过对生态保护红线内涵的分析,旨在探究生态保护红线归责机制的完善,希望能为我国生态保护红线制度相关法律责任的明确提出有益的解决方案。

The ecological protection red line is a breakthrough system proposed by China in the field of environmental protection in recent years. In 2014, China promulgated the newly revised Environmental Protection Law of the People's Republic of China, which clearly put forward this concept. What is cer-tain is that this is an improvement in China's ecological environment legislation, indicating the determi-nation of China to use legal means to protect the ecological environment. However, although the concept of this system is currently in place, there are still many problems in the actual operation. How to realize the refinement of this system and clarify the corresponding legal responsibility is an important step to re-alize the management of ecosystem. Through the analysis of the connotation of ecological protection red line, this paper aims to explore the improvement of the red line attribution mechanism of ecological pro-tection, and hopes to provide a useful solution for the clear legal responsibility of China's ecological pro-tection red line system.
