摘要
解雇保护制度直接影响着用工安全性和灵活性,关乎着社会经济的发展。与发达国家相比,我国在劳动者过错行为原因的解雇、劳动者本身原因的解雇以及经济性裁员中均存在着对劳动者倾斜保护过度的问题,进而造成新形式的不公平。为了增强我国经济在国际上的竞争力,有必要完善解雇保护制度,提高我国企业的用工灵活性,具体措施应为:适当降低劳动者过错行为原因和劳动者本身原因的解雇保护力度、放宽对经济性裁员中优先留用人员的限制、创设解雇保护豁免制度。
Dismissal protection system directly affects the safety and flexibility of employment, and is related to the development of social economy. Compared with developed countries, there are some problems of overprotection of workers in the aspect of dismissal due to worker’s faulty behavior, their own reasons and the economic dismissal, which in turn leads to new forms of unfairness in China. In order to enhance the competitiveness of China's economy in the international arena, it is necessary to improve the dismissal protection system and improve the flexibility of employment of Chinese enterprises. The specific measures should be taken, which include appropriately reducing the protection of dismissal due to worker’s faulty behavior and their own reasons, and relaxing the priority of retaining employee in economic dismissal and establishing immunity system of the dismissal protection.
