摘要
从讨论新修订《承包法》与《物权法》的衔接,发现《物权法》与新修订《承包法》的物权设置和权利接口不相匹配。为解决我国新时代“三农问题”,打破当前农地经营僵局并完成产业融合发展,既需要延续以农村土地集体所有权为基础的双层经营体制,又需要建立以土地经营权为基础的多元经营格局。因此,农村土地双层经营体制需要科学重述,应在当前编纂《民法典物权篇》中重新设置农村土地集体所有权和土地经营权的二元结构。
The purpose of the paper is to discuss connection between the rural land contracting law and real right,and try to look for a scientific restatement in the real rights section of the civil code.The results indicate that the current property law does not match the property right setting,the right system and position are not accurate enough.Objectively,it is necessary to continue the double-layer management system focusing on the collective ownership of rural land,and to establish the diversified management pattern based on the right of land management.The research conclusion is that restatement path is to set up the dual structure of rural land collective ownership and land management right in the real right chapter of civil code compilation.
