Natural Law,Ownership and the World’s Natural Resources

在当前有关所有权的哲学反思中,托马斯自然法理论构建了一条独特的进路,然而,所有权的自然法观念还未在当下的哲学讨论中占有一席之地。面对这样的挑战与机遇,波义尔根据对阿奎那的“新自然法理论”(NewNaturalLawTheory)式解读,重新理解所有权及其相关议题,提出了所有权的自然法观念的三项基本主张,它们分别涉及占有、共同利用与据有(或所有),进而指出了这三项主张的规范性基础,澄清并回应了有关所有权(或财产)安排的几项现存或潜在的质疑。在上述分析的基础上,波义尔聚焦世界的自然资源这个具体领域,针对世界的自然资源,提供了所有权的自然法观念版本的独特理解与思考。

Within present philosophical reflection on ownership, St. Thomas natural law tradition constitute one of the rather distinctive approach, But, Natural law conception of ownership have not yet earned a place in contemporary philosophical discussions. in the face of such situation, according to New Natural Law Theory’s reading of Aquinas, Joseph Boyle rethinks the issue of ownership and its relevant questions, this essay first states the three propositions of natural law conception of ownership, respectively, they are relative to possess, common use, and appropriate/own, furthermore, it indicate the normative foundation of the above three propositions, clarification and answers is provided for some existing and potential doubts of property and ownership arrangement. Finally, based on the analyse above, it focuses on specially the issue of the world’s natural resources to which the version of natural law conception of ownership is provided.
