Seventy Years Exploration of National Security and Rule of Law with Chinese Characteristics: History and Experience

中国特色国家安全法治建设是中国特色社会主义法治体系建设的重要内容。新中国成立70年以来,国家安全法治建设经历了以国防建设和政权安全为出发点的国家安全法制初创与曲折发展时期、以传统国家安全观法律化为重点的国家安全法制形成与完善时期、以及自2012年至今以总体国家安全观为指导加快国家安全法治建设等三个时期。在此过程中,形成了从国家安全法制建设到国家安全法治建设、从国家安全的法律之治到国家安全的良法善治、从传统国家安全观到总体国家安全观、从以政权安全为中心到以人民安全为宗旨、从侧重保护国家安全到国家尊重和保障人权、从注重反间谍工作到维护总体国家安全、从国家安全机构法到国家安全基本法、从维护中国国家安全到构建人类命运共同体的发展轨迹。

The construction of national security rule of law with Chinese characteristics is an important part of the construction of the socialist rule of law system with Chinese characteristics.Since the founding of the People's Republic of China 70 years ago,construction of national security rule of law has experienced three development periods:The period of initial creation and tortuous development of National security legal system based on the National defense construction and political security;The period of formation and improvement of the national security legal system focused on the legalization of the traditional national security concept;With the general national security concept as a guide to accelerate the construction of national security rule of law from the year 2012 till now.During this process,development track has formed as below:From the construction of national security legal system to the construction of national security rule of law,from the rule of national security law to the good law and good governance of national security,from the main focus of hidden science to the dominant school,from a traditional national security concept to the general national security concept,from the regime security centered to the people's safety for the purpose,from focusing on protecting national security to respect and protect human rights,from counter-espionage to maintenance of general national security,from the National Security Department Law to the National Security Basic Law,from the maintenance of China's national security to the construction of human destiny community.And experience also accumulated:Under the leadership of the Communist Party of China;Joint promotion of the rule of law and the national security and the rule of law;Concept of National security and national development two-wheel drive;Coordinated and Dialectical National Security Strategic Thinking;National Security and Rule of Law with Chinese Characteristics;Enrich and expand the national security connotation;Coordination of Scientific layout and key breakthroughs;Construction of National Security Rule of Law Commitment to Chinese Security and Global Security.At this point,National Security and Rule of Law with Chinese Characteristics has been formed.
