“一带一路”国际商事仲裁合作联盟的构建

西方国家主导下的现行国际商事仲裁体系与“一带一路”倡议并不匹配,这源自西方传统和西方话语体系带来的文化和法律理念差异及由此造成的参与困境。为此,创建以削减文化和法律理念差异带来的负面障碍为出发点,以共商共建共享理念为指引的“一带一路”国际商事仲裁合作联盟具有应然性,它比我国主导构建的单一国际商事仲裁中心更具价值。作为一个着眼于长远的机制,仲裁合作联盟应以“一带一路”国际商事争端预防和解决中心这一非政府间国际组织的社会团体法人为整体平台支撑,具备共享的仲裁服务、独立的案件裁决以及创新的联合仲裁功能相结合的多重复合功能,逐步推动“一带一路”国际商事仲裁区域共同体的形成。

The mismatch between the current international commercial arbitration system and the needs of the Belt&Road Initiative lies in the legal culture gap.It is thus of great value to create an arbitration cooperation alliance aiming at eliminating adverse impact of difference in culture and legal ideas,based on the idea of shared growth through discussion and collaboration.The new arbitration cooperation alliance shall be organized as a secondary institution of the International Disputes Preventing and Resolution Center,the latter of which shall be registered as a social group with status of legal person.The arbitration cooperation alliance shall have the ability to offer shared arbitration service,independent arbitration and co-arbitration,and to promote the formation of a regional arbitration center.
