博物馆藏品数字化著作权问题研究

A Study on Copyright Problems of Museum Collections’ Digitization

博物馆作为重要公共文化服务机构之一,对其藏品进行数字化有利于更好地发挥博物馆的社会功能。然而为藏品保存、公众获取等目的进行的数字化涉及很多著作权问题,一方面数字化过程中的影像化、作品汇编等行为产生博物馆所有的著作权;另一方面对现存作品进行数字化也存在侵犯其他著作权人复制权、展览权、信息网络传播权等权利的风险。为此,有必要在博物馆藏品数字化全过程中进行著作权管理,达到著作权利用和侵权风险防范的双重目的。

As one of important public cultural service agencies,museum can better fulfil its social function by digitizing its collections.However,digitization for collection preservation or public access purposes involves many copyright issues.On the one hand,the visualization,compilation of works,etc.in the digitization process can bring about the copyright ownership of museum.On the other hand,digitizing existing works also runs the risk of infringing other copyright owners’rights to copy,exhibit,and communicate information online.Therefore,it is necessary to carry out copyright management in the whole process of digitization of museum collections,achieving the dual purpose of copyright protection and infringement risk prevention.
