实施专利投机行为的投机NPE会扰乱正常的市场竞争秩序,目前NPE已经在中国提起专利诉讼,且中国专利保护水平也在逐步提高,有迎来大规模NPE诉讼的可能。因此,中国有必要借鉴美国的成功经验,从提高专利质量、促进科技成果转化、监管专利交易、完善专利诉讼程序和建立合理的专利侵权赔偿制度等方面规制NPE的专利投机行为。

The patent speculations of Non-Practicing Entities (NPEs) disrupt the normal market competition. At present, NPEs have initiated patent litigations in China. Against the background that China is making efforts to protect patentees, it is possible for the occurrence of a large number of NPE litigations in China. Therefore, it is necessary to draw lessons from the United States to regulate NPEs’ patent speculations by improving patent quality, promoting the transformation of scientific and technological achievements, supervising patent transactions, improving patent litigation procedures and establishing a reasonable patent infringement compensation system.
