摘要
信访听证制度作为一种民主参与政治的公民权益救济制度,具有衡平司法权威和公众参与行政权利、监督约束行政行为、协调化解社会矛盾、实现有序信访的多重功能。但随着新时期的信访呈现出规模性、复杂性、多样性等一系列新特征,信访听证制度也因其必要性和实践中的诸多不足之处而亟待完善。本文结合信访听证的实践,提出诸如完善启动机制、确保程序正义、强化信访代理人制度、强化责任意识和引导教育功能、建立回访机制等对策。
As a relief system for citizens’ rights and interests of the democratic participation in politics,the petition hearing system has multiple functions,such as balancing the judicial authority and public participation in administrative rights,supervising and restraining administrative acts,coordinating and resolving social conflicts,and realizing the orderly petition.However,with a series of new characteristics,such as the scale,complexity and diversity,the petition hearing system in the new era also needs to be improved due to its necessity and shortcomings in practice.Based on the practice of petition hearing,this paper puts forward some countermeasures,such as perfecting the starting mechanism,ensuring the procedural justice,strengthening the petition agent system,strengthening the sense of responsibility and guiding education functions,and establishing the return visit mechanism.
