On the Application of the Principle of Change of Circumstances in Contract Law

本文分析了情势变更原则的概念,从各种法律制度之间的比较作为切入点,分析法律效果,并阐述了其在商品房交易纠纷中的适用、在旅游合同中的适用、在赠与合同中的穷困抗辩权的体现、以及他们当中出现的一系列问题。从国家立法的角度,提出了完善我国形势变化原则的一些法律思考。

This paper starts with analyzing the concept of circumstance change and comparison between different legal systems, analyzing the legal effect of principle of circumstance change, elaborating the application of circumstance change in dispute over real estate trading, travel contract, right of defense in poverty in grand contract and series of relevant problems. Put forward some legal advice to perfect the principle of circumstance change in China from national legislation.
