论党内法规的形式规范性及其创造性转化

A Brief Discussion on Formal Normalization of Regulations Within Party and The Creative Transformation

党内法规是中国特色社会主义法治体系的有机组成部分,全面依法治国战略的实施需要形式结构完善的党内法规提供规范支撑和主体保障。党内法规自身必须是一个统一、明确的规则体系,应具有体系结构完善、效力等级与规范形式严格对应、规范逻辑结构清晰、统一明确的基本范畴等特征。在完善党内法规的形式结构的前提下,通过形式规范性与实质理性相融合的路径,用党内法规承载的实质价值"俘获"形式规范性,从而实现对党内法规中形式规范性的创造性转化。

The regulations within party is an organic part of the socialist rule of lawsystem with Chinese characteristics. The implementation of the strategy of comprehensively governing the country according to lawrequires formal support and subject protection provided by regulations within party with perfect formal structure. Therefore,the regulations within party must be a unified and clear system of rules,which should have the characteristics of perfect system structure,strict correspondence between the level of effectiveness and the form of norms,clear logical structure of norms,and unified and clear basic categories. Under the premise of perfecting the formal structure,we must use the path of the integration of formal normalization and substantive rationality,and use the substantive value of regulations within party to "capture"the formal normalization,thus realizing the creative transformation of formal normalization in regulations within party.
