System Construction and Path Selection of the Legalization of State Governance

作为法治建设和法学研究中新的时代性重大课题,对国家治理法治化的探讨需要在社会转型与制度改革的动态背景下进行,并牢牢把握"国家、政府与社会"的关系这一核心研究对象。在全面推进依法治国、实现国家治理法治化的进程中,应认识到法治建设是一个包含价值基础、目标、基石、路径、方案等要素的逻辑严密、体系严谨、宏大的国家建设系统工程。完整的国家治理法治化的体系建构应当包含价值体系、关系体系、实施体系和评估体系。对国家治理法治化体系中各个具体要素的研究,则必须要以理解当前国家治理现状和治理难题为出发点,结合中国的独特语境和时代背景,在多个路径和多个层面上作综合分析,寻找实现国家治理法治化的路径。

The legalization of state governance is a major subject of in the construction of the rule of law and the study of law in the new era. The discussion of this topic should be carried out under the background of social transformation and institutional reform in a dynamic way. And the core research object is the relationship between the state, the government and the society. In the process of comprehensively advancing the rule of law and realizing the rule of law in national governance, we should pay attention to the fact that the construction of the rule of law is a logical, systematic and grand systematic project of national construction, which includes the elements of value foundation, goal, cornerstone ,path and scheme. The construction of a complete legal system of national governance should include four systems: the value system, the relationship system, the implementation system and the evaluation system. The study of the specific elements in each of these systems must start from the understanding of the current state of national governance and its Gordian Knot, along with the unique context and era background of China, and conduct a comprehensive analysis on multiple paths and levels to finally find the path to the legalization of state governance.
