余江县农村宅基地改革试点的探讨

Discussion on Reform of the Rural Homestead in Yujiang County

2015年3月江西省余江县被列为全国宅基地制度改革试点县,2016年9月余江县承担了农村宅基地、集体性建设用地入市、土地征收制度改革3项试点。介绍了余江县宅基地使用制度改革措施,包括有偿使用超面积的宅基地、宅基地流转、宅基地退出3个方面。针对余江县在改革中存在一些的问题进行了分析探讨。结果表明,成立理事会、制定村庄规划和宅基地管理章程、规范宅基地申请与建设、拆除不合法的房屋是农村宅基地改革的重要内容,对于继承得来的宅基地,收取使用费没有法律依据,应该鼓励在农村有老宅的人退休后回村养老。

Yujiang County was listed as the pilot of the reform for the rural homestead in March 2015. In September 2016,Yujiang County undertook three pilot projects,including the reform for the rural homestead,the reform of the market of rural construction land,the reform of land impressments’ system. We introduced the reform for the rural homestead in Yujiang County,including three aspects of paid using over-area for the rural homestead,currency of the rural homestead,and exit of the rural homestead. The research results showed that measures for the reform of the rural homestead including establishment of councils,designing village planning,establishing the regulations of the management of homestead land,standardized application for homestead land and the demolition of illegal houses. We also argued that it was illegal to charge fees for inherited homesteads,and we should encourage the retirement people to retire to their villages.
