研究生导师的权利诉求及其规范的制定

The Right Claims of the Graduate Supervisors and the Written Norms

将部分研究生院高校的导师权利条款与导师权利诉求的调查结果进行比较,发现:权利条款对导师高度认同的招生自主权、指导评价权、获优先支持与奖励权的规定较多;但对人文社科导师的权利诉求,条款未能有所体现;对导师们关心的申诉权、与不合格学生解除指导关系的权利、与指导活动相关的署名权,文本缺乏可供参考的程序性规定和适用范围的说明性条款。因此,建议紧扣岗位特征,制定合理灵活的权利条款;尊重学科差异,适当关照人文社科导师的权利诉求;细化权利条款,真正落实权利保障和救济机制。

Comparing the clause of the graduate supervisors’ post rights from some graduate schools with the survey results of their rights,this study finds out that the clause of the rights has more provisions on the rights of the enrolment autonomy,guidance evaluation,priority support and reward that the graduate supervisors highly recognize;the right claims of the graduate supervisors from the humanities and social sciences have not been reflected;the texts lack the procedural provisions of the reference and the descriptive provisions of the application scope on the rights of petition,dissolution of the guidance relationship with unqualified students and the authorship related to the guiding activities.Therefore,it is suggested that provisions should be made including keeping close to the characteristics of the post,formulating reasonable and flexible clauses of the rights,respecting disciplinary differences,considering the right appeals of the humanities and social sciences supervisors,refining the clauses of the rights and implementing the protection and relief mechanism of the rights.
