专利法第四次修改背景下的专利行政保护现状与思考

Current Status and Thinking of Patent Administrative Protection Under the Background of the Fourth Revision of Patent Law

目前,我国正在进行专利法第四次修改,本文首先分析了近几年我国专利行政执法的情况,表明专利行政保护需求旺盛,接着从专利法修正案(草案)的具体条文入手,对新增或优化的专利行政保护手段进行分析,指出专利法修改将大大提高行政处理专利侵权纠纷的效率和效果,最后提出进一步完善行政保护与司法保护衔接机制的建议。

At present, China is carrying out the fourth revision of the Patent Law. This paper first analyzes the situation of China's patent administrative enforcement in recent years, indicating that the demand for patent administrative protection is strong, and then starts with the specific provisions of the Patent Law Amendment (Draft) to analyze the added or optimized patent administrative protection measures. After analyzing, pointing out that the revision of the patent law will greatly improve the efficiency and effectiveness of administrative treatment of patent infringement disputes, and finally put forward suggestions for further improving the linkage mechanism between administrative protection and judicial protection.
