《专利审查指南》(以下简称《审查指南》)属于国务院部门规章,司法界及学界对其法律适用缺乏全面系统的认识,对遵循何种适用原则并不明确,由此引发诸多问题与争议。本文从法理学、《审查指南》的自身演进、司法导向需求以及域外经验等角度,论证在专利诉讼中正确适用《审查指南》的必要性,并树立应严格贯彻执行“法不溯及既往,从旧兼有利”基本原则的立场,强调准确理解并适用不同版本《审查指南》的相关规定的重要性,为确保《审查指南》在专利诉讼中的正确适用提供建议。

Guidelines for Patent Examination (hereinafter the Guidelines ) belongs to the State Council's regulations. Nevertheless, both the judiciary and the academic communities lack a comprehensive and systematic understanding of its legal application, nor are they clear about the applying doctrine to be followed, which has led to many problems and controversies. This paper demonstrates the necessity of correctly applying the Guidelines in patent litigation from the perspectives of jurisprudence, the selfevolution of the Guidelines , the demand of judicial guidance and the extraterritorial experience, etc. It also establishes the position of strictly following and implementing the basic doctrine of "Law of nonretroactivity, observing old laws and ones favorable to the parties concerned", stresses the importance of accurately understanding and applying the relevant provisions of different versions of Guidelines , and makes proposal of ensuring the correct application of the Guidelines in patent litigation.
