摘要 良好的区块链争议解决方案是未来区块链技术顺利发展和良好治理的关键要素。当前存在两种区块链争议解决路径:"传统模式"试图以区块链上虚拟财产的物权化和"对物管辖权"为依据,以传统司法制度解决区块链争议;"分布式"争议解决机制则设计出一套基于区块链自治的匿名化争议解决方案。"传统模式"有利于增强区块链上法律适用的确定性和公权力对区块链的控制,但与区块链匿名化和去中心化的本质冲突。"分布式"争议解决机制有助于争议的专业化解决和区块链的发展,但短期内实现较为困难。采用"混合模式"作为两种治理模式的过渡方案,有助于推动区块链技术的发展和治理现代化。 A good blockchain dispute resolution mechanism is the key element for the future development and good governance of blockchain technologies.Currently there are two blockchain dispute resolution mechanisms:"traditional model"attempts to resolve blockchain disputes in traditional judicial systems based on the idea that virtual properties can be treated as tangible properties and the courts can exercise its"in rem jurisdiction";the distributed dispute resolution mechanism is designed as an anonymous dispute resolution mechanism based on the autonomy of the blockchain.The"traditional model"is conducive to enhancing legal certainty on the blockchain and the public power’s control over the blockchain,but it contradicts with the anonymization and decentralization nature of the blockchain.The"distributed"dispute resolution mechanism contributes to the professionalism of dispute resolutions and the development of the blockchain,but it is difficult to achieve in the short term.The adoption of"hybrid model"as a transitional solution between these two governance models will help to promote the development of blockchain technology and modernization of blockchain governance.
