国际商事法庭对国际商事仲裁的影响——以新加坡国际商业法庭和伦敦商事法庭为例

The Impact of International Commercial Court on International Commercial Arbitration——Taking the Singapore International Commercial Court and the Commercial Court of England and Wales as Examples

近年来,国际上兴起建立国际商事法庭的潮流。根据《2018年国际仲裁调查》,国际商事仲裁的优势主要包括裁决的可执行性、避开特定法律制度或国内法院、灵活性、当事人可选择仲裁员。这四项优势无法完全被国际商事法庭取代。对伦敦商事法庭、伦敦国际仲裁院、新加坡国际商业法庭,以及新加坡国际仲裁中心的年受案量等数据进行的实证分析证明,伦敦商事法庭和新加坡国际商业法庭的设立并未对伦敦国际仲裁院和新加坡国际仲裁中心产生消极影响。本文认为国际商事法庭与国际商事仲裁之间是相辅相成、合作互补的关系,因而国际商事法庭对国际商事仲裁的影响是积极的。

The trend of establishing the international commercial court has arisen internationally in recent years. Pursuant to the 2018 International Arbitration Survey, the advantages of international arbitration mainly consist of enforceability of awards, avoiding specific legal systems or national courts, flexibility, and ability of parties to select arbitrators, which cannot be completely replaced by the international commercial court. An empirical analysis of data from the Commercial Court of England and Wales, London Court of International Arbitration,Singapore International Commercial Court and Singapore International Arbitration Centre proves that the establishment of the Commercial Court of England and Wales and the Singapore International Commercial Court does not impose a negative impact on London Court of International Arbitration and Singapore International Arbitration Centre respectively. This article holds the opinion that the relationship between the international commercial court and international commercial arbitration is complementary and cooperative, and thus the impact of international commercial court on international commercial arbitration is positive.
