互联网音乐平台的法律义务——以对内容违法违规产品的审查为切入点

Legal Obligation of Internet Music Platform:Reviewing the Content of Illegal Products as a Starting Point

《圣诞夜》歌词违法违规事件引发国内外关注,文化部亦曾查处大量内容违法违规的音乐产品。内容违法违规产品在非议中一直能够传播流通,凸显了互联网音乐平台对自身担负的审查义务认知不足。传统上,对互联网音乐平台的审查义务讨论多局限在互联网音乐平台著作权及其相关权领域;忽略了平台对非侵犯他人著作权、但内容违法违规音乐产品的审查义务。互联网音乐平台作为经营音乐产品的责任主体,本应对违法违规产品负有法定审查义务。其审查义务具有可能性、必然性,但亦应存在对审查义务范围的限制。因此,如何推动网络音乐平台妥善履行审查义务、净化网络文化环境,在立法、执法与司法层面做出应有的回应,是健全社会主义法制的时代体现。

The event of pop song "Christmas Eve" lyrics violating of laws and regulations has caused concern at home and abroad.The Ministry of Culture has investigated a large number of similar content illegal music works.Content illegal works that has been able to spread in the criticism reflects the fact that internet music platforms neglect the review obligations and legal liabilities.Traditionally digital music platforms' review obligations are limited in the field of copyright and related rights,however,content illegal music works also need to be reviewed and examined by platforms.Based on the definition and development,attributes and characteristics of digital music platform,in this paper the review obligation of digital music platforms are probed into,including the possibility,inevitability and limitation of the scope of the obligation,and how to promote platforms to fulfill the duty,so as to provide suggestions for purifying the network culture environment.
