中哈货物贸易条约问题与对策研究

Research on Problems and Countermeasures of Goods Trade Treaty between China and Kazakhstan

中哈货物贸易条约在推动双方货物贸易发展过程中逐渐显现出若干弊端,尤其是两国早年签署的双边货物贸易条约,在条约的解释、实施、监督、冲突化解等方面存在诸多问题,从而在一定程度上增加了中哈货物贸易条约实施的难度。中哈合作委员会作为两国开展广泛交流与合作的重要机制,在促进条约实施过程中其作用也并未得到充分发挥。加之欧亚经济联盟相关条约的落实,对中哈货物贸易条约产生了较大冲击。我国应当尽早与哈萨克斯坦开展有效沟通,根据条约本身及实践中出现的问题构建较为完备的中哈货物贸易条约制度。

The goods treaty singed by China and Kazakhstan in the process of developing bilateral trade in goods gradually revealed a number of drawbacks, especially in the early years of the two states singed bilat-eral trade in goods, for example the treaty interpretation, implementation and supervision, treaty between conflict resolving has many problems, which to a certain extent, increased the difficulty of implementation of the goods trade treaty signed by China and Kazakhstan. China and Kazakhstan established a cooperation com-mittee as the important mechanism of the extensive exchanges and cooperation between the two countries, its role in promoting treaty implementation also did not get full play. Combined with the implementation of the relevant treaty,The Eurasian Economic Union has a larger impact on the goods trade treaty singed by China and Kazakhstan. China should communicate effectively with Kazakhstan as soon as possible,according to the prob-lems in the practice of the treaty itself and build a relatively complete system of bilateral trade in goods of the treaty.
