Re 一 examination of Local Legislative Interpretation

修订之后的《立法法》扩大了地方性立法的主体范围,但地方立法解释的实施情况却存在着许多问题:如立法解释相关规定不充分,形式规范的地方立法解释实践少、解释权运行不到位等。这种困境主要是由于解释权归属不明确、权力运行程序不规范所导致。应从明确设区市地方立法解释主体的法律地位、严格规范地方立法解释运行程序、建立监督机制等方面规范地方立法解释。

Although the amendment of the Legislation Law has expanded the scope of lawmaking authority, the implementation of legislative interpretation of local regulations is not optimistic. For example, the relevant provisions of the legislative interpretation are not adequate, and there is little practice of normative interpretation ,and the right of interpret is not really in force and so on. This dilemma is mainly due to the unclear attribution of interpretation right and the non - standard operation procedures. The interpretation of local regulations should be regulated from the following aspects, such as clearly defining the legal status of the local reg丒 ulations interpretation of the prefecture cities, strictly regulating the operating procedures of interpretation, and establishing the supervision mechanism.
