摘要
在知识产权法语境下,出版物的封面设计具有两个面相以及多重属性,故其应受到知识产权的多元保护。一方面,因封面设计为智力活动的成果,就其艺术性而言,当设计达到作品的独创性要求时,封面设计可受到著作权的保护;而就封面用于出版产品这一特性而言,当封面设计具有新颖性和区别性时,出版者可就该设计申请专利,将其作为外观设计,通过专利权予以保护。另一方面,如果出版者在生产经营活动中,使封面设计承载了商誉,其又可以通过商标权或者反不正当竞争法来进行保护。
In the context of intellectual property, there are two aspects and multiple attributes of the cover design of publications. Hence, the cover should be protected by intellectual property from multiple dimensions. On the one hand,the cover design derives from the intellectual activities. Considering the design’s artistic creation, when it meets the requirements for originality, the cover should be protected for its copyrights. Considering covers as publishing products,when it has the qualities of novelty and distinction, the publisher could apply for a patent to protect it. On the other hand, if the cover contains the reputation of a business in production and management, it could be protected by the trademark law or the anti-unfair competition law.
