Research on the Rights of Broadcasting Organization Under the Background of the Tri-networks Integration

三网融合正处于各自独立、互相竞争的有保留融合的背景下,广播组织权有从合同权利转化到开放财产权的趋势。广播组织将复制著作权人的权利并带来多重诉讼;对广播组织权的赋能,成为传媒市场进出壁垒和路径依赖,给传媒市场绩效带来负面影响。通过对美国广播组织及其权利定位的历史考察,启示我国采用有限排他权措施,平衡行业各主体的利益,创造公平的市场竞争环境。基于我国广播电视组织内容上的竞争优势,以及司法实践不支持将广播组织权扩张到互联网的态度,分阶段在广播组织传播的内容、传播的信号使用上,适用法定许可。

Under the background of independent,competitive and reserved integration of the telecommunications networks,cable TV networks and the Internet,the right of broadcasting organization has the tendency of transforming from contract right to open-ended property right.Broadcasting organizations will duplicate the rights of copyright owners and bring multiple litigation,and the empowerment of broadcasting organizations will become barriers to the entry and exit of the media market and path dependence,which will have a negative impact on the performance of the media market.Through the historical investigation of the broadcasting organization and related rights orientation in the United States,it is enlightened that China should adopt the measures of limited exclusionary right,balance the interests of various subjects in the media industry,and create a fair market competition environment.Based on the competitive advantage in the content of radio and television organizations in China and the attitude that the judicial practice does not support the expansion of the rights of broadcasting organizations to the internet,the statutory'license is applied to the content transmitted by broadcasting organizations and the use of transmitted signals in stages.
