本文对政府采购范围界定的主要因素、政府固定资产投资的性质及管理体制进行了总结,阐述了《政府采购法》与《招标招投标法》适用范围的衔接问题,指出了政府固定资产投资建设项目的法律适用情形,并对招标采购相关法律规制及监管体制完善提出了初步建议。文章旨在为行政主管部门实施招标采购行政监管提供参考。

This paper summarizes the main factors defining the scope of government procurement, the nature of government fixed asset investment and the management system, expounds the connection between the application of the Government Procurement Law and the Tendering and Bidding Law, and points out the construction of government fixed assets investment. The legal application of the project and the preliminary recommendations on the legal regulation of the bidding procurement and the improvement of the supervision system. The article aims to provide reference for the administrative department to implement the administrative supervision of bidding procurement.
