中国《体育法》修改的总体思路——基于国外体育立法修法经验的分析

The Overall Thinking of the Modification of China’s Sports Law——Analysis Based on the Experience of Foreign Sports Legislation and Modification of the Law

《中华人民共和国体育法》自1995年颁布以来,在我国经济社会和体育事业方面发挥了巨大作用是不争的事实。24年来我国各领域发生了深刻的变革,现行体育法已经不适应我国经济社会的需求,严重制约了我国体育事业的健康发展,体育法的修改势在必行。美国、欧盟、日本等发达国家或地区体育立法修法的经验为我国体育法的修改提供了有益借鉴。结合我国体育法学领域关于修改体育法的各种观点,从坚持中国共产党的领导、坚持以人民为中心的理念、坚持以权利与义务为内容主线、坚持全面融入社会主义核心价值观、坚持以问题为导向、坚持国际视野等方面阐述了我国体育法修改的总体思路。

Having been issued since 1995,it is an indisputable fact that the current Sports Law of People’s Republic of China has played a huge role in economic society of our country.But after 24 years,profound changes have taken place in various fields of our country, Sports Law of People’s Republic of China is already inadaptation of economic and social demands of our country,seriously restrict sound development of the sports in our country,the revision of the Sports Law of People’s Republic of China is imperative.The experience of United States,EU and Japan’s legislation and amendment of sports law can give us useful reference.On the basis of discussion of diverse viewpoints in regard to sports law revision of our country,the thinking of the sports law revision was proposed from perspectives of insisting on the leadership of the Communist Party of China,people-centered concept,right and obligation are the main content thread,problem-orientated,fully integrate socialist core values and international vision.
