“互联网实时转播”法律定性的思考——中超直播侵权案之侵犯广播权认定事宜之商榷

Legal Characterization of Internet Real-time Broadcasting

结合中超体育赛事直播一案,从广播权不包含有线广播行为以及“有线转播”不包含互联网转播两个方面进行论证和分析,对其网络实时转播的行为应当适用何种著作权规制进行了探讨,认为应当适用兜底权利进行保护,同时提出对技术的发展带来的法律问题在超出法律解释范围时应当由立法进行明确,而非司法扩张。

Based on the case of live broadcast of CSL,this paper demonstrates and analyzes two aspects,i.e.,broadcasting right does not include cable broadcasting behavior and cable broadcast does not include Internet broadcast.This paper probes into what kind of copyright regulation should be applied to the behavior of internet real-time broadcast,and holds that the right to cover the bottom should be applied to the protection of the copyright.At the same time,it is pointed out that the legal problems caused by the development of technology should be clarified by legislation rather than judicial expansion when they go beyond the scope of legal interpretation.
