工程质量保证金的返还期限问题涉及何为工程质量保证金、工程质量保证金的性质,工程质量保证金与工程质量保修金的区别,缺陷责任期、质量保修期的区别,不同情况下工程质量保证金的返还期限如何确定以及工程质量保证金返还后保修义务如何承担等问题。梳理铁路建设工程质量保证金、质量保修金、缺陷责任期及质量保修期的概念、出台背景和相关制度,并对几个概念进行对比分析,剖析了工程质量保证金的法律性质,以求促进铁路建设工程合同质量保证金管理。

The issue of the return period of the project quality guarantee involves what is the project quality guarantee and the characteristic of pro-ject quality guarantee, and the difference between the project quality guarantee and the project quality guarantee, the difference between the defect liability period and the quality guarantee period, how to determine the return period of the project quality guarantee under different circumstances,and how to undertake the guarantee obligation after the return of the project quality guarantee. This paper summarizes the concepts, background and relevant systems of quality guarantee, quality guarantee, defect liability period and quality guarantee period of railway construction projects, and makes a comparative analysis of several concepts, deeply analyses the legal nature of quality guarantee, which plays a promoting role in strengthening the quality guarantee management of railway construction contracts.
