摘要 宅基地使用权一味禁止抵押的深层次原因在于一旦允许宅基地使用权抵押将导致政府成为最终责任承担者。而《民法总则》将农村集体经济组织作为特别法人来规定则将从根本上解决这一问题,从而为宅基地使用权抵押提供了主体制度保障。应当坚持在“房地一致”的规则下,允许将宅基地使用权与建造其上的农村房屋一并抵押。为了保障宅基地使用权不流转至集体之外,应当赋予农村集体经济组织法人在相同条件下的优先购买权。 The deep-seated reason for the exclusive prohibition of mortgage of the right to use homestead lies in that once the mortgage of the right to use homestead is allowed, the government will become the ultimate responsibility undertaker.The General Principles of Civil Law stipulate rural collective economic organizations as special legal persons, which fundamentally solves this problem, thus providing the main body system guarantee for this problem. We should adhere to the rule ofconsistency of premisesand allow the right to use residential land to be mortgaged with the rural houses built on it. In order to ensure that the right to use homestead transferin the collective, the legal person of rural collective economic organizations should be given priority to purchase under the same conditions.
