摘要
社会工作发展到一定规模需要立法加以规范;社会工作的发展瓶颈需要立法加以突破;社会工作制度体系也需要立法加以确立和引领。社会工作立法应当坚持社会法的基本定位,遵循培育发展和规范管理相结合、继承和创新相结合、立足现实和面向未来相结合的原则,从职业角度和事业角度展开,具体表现为《社会工作者条例》和《社会工作条例》。社会工作立法的重点和难点是设置社会工作者就业准入。没有就业准入,职业立法的意义将大打折扣。
Legislation of social work is needed when social work develops to a certain scale.The bottleneck of social work development needs to be broken through by legislation,and the social work system needs to be established and led by legislation.Social work legislation should adhere to the basic positioning of social law,and follow the principle of the combination between development and management,inheritance and innovation,the reality and the future.Legislative model includes the occupation perspective and enterprise perspective,which is embodied in“Social Worker Regulation”and“Social Work Regulation”.The key and difficult point in legislation for social work is to set up employment permission for social workers.Without employment permission,the significance of the occupational legislation will be greatly reduced.
