创新生活世界的秩序表达——论知识产权立法之当代使命

The Representation of Legal Order in Innovation World:On the Historical Mission of Contemporary IP legislation

在民法典编撰进入加速阶段的今天,知识产权如何体系化、系统化在学界引发了较大的争议。相比分散的单行法或在民法典中独立成编的模式,在民法典之外,制定一部独立的《知识产权综合法典》,是彰显创新者地位、为国家知识产权治理体系提供法律基石的最优方案。《知识产权综合法典》制定中,必须处理好价值定位、权利属性、客体抽象、保护范式等重大理论问题。由于知识产权体系化中面临不少技术性难题,因此,采取一种“两步走”的方案是可取的:近期内,尽快制定一部糅合实体性与程序性规范的综合性知识产权基础法律,即《统一知识产权法》;在《统一知识产权法》的基础上,在不远的将来,制定一部“内容协调、体系完备、文字优美”的《知识产权综合法典》,以期为创新者的生活世界提供统一的生活秩序。

With the codification campaign of civil law entering an accelerating phrase,how and should IP law be adopted into the Civil Code,initiates heated debates. Comparing to the patterns of separate regulations,or as a special part adopted into Civil Code,formulating an independent IP Code,which is subordinated to Civil Code,should be a better solution to the protection of innovators′ benefits.To codify IP law successfully,it should solve a few major theorectical issues such as value orientation,innate character of IP rights,the abstraction of IP object,mode of protection,and etc. firstly. Due to the dreadful technical barriers in the drafting procedure of IP code,it′s better to take a two-step strategy: First,formulate a comprehensive IP law with procedure norms as well as substantive norms in the short term,named IP Fundemental Law;Second,on the basis of IP Fundemental Law,formulate a clear,complete and elegant IP Code in the near future,to provide uniform order for the innovation world.
