信赖原则在过失犯罪理论中占据着重要的地位,是传统过失犯罪理论随着社会转型而适应社会变化的一个重要结果,对于过失犯罪的认定有重大影响。目前,学界对于信赖原则在交通事故领域犯罪中的研究比较深入,但是在涉食品、药品犯罪领域的研究鲜有涉及。将信赖原则适用于食品、药品犯罪领域具有可行性和必要性,但是也必须遵循一些限制性条件。

It is the traditional criminal negligence theory with social transformation and an important result of adapt to social change, it have a huge impact for the cognizance of criminal negligence. At present, the academic circle has conducted in-depth studies on the trust principle in the field of traffic accidents, but there are few studies on the field of food and drug crimes. It is feasible and necessary to apply the principle of confidence to the field of food and drug crime, but certain restrictive conditions must be followed.
