国外马克思主义法律思想评析——以伦纳、帕舒卡尼斯和柯林斯为考察对象

Overseas Marxist Legal Thoughts and Appraisal Thereof: With a Focus on Renner, Pashukanis and Collins

马克思主义法律思想研究是当今国外马克思主义理论的重要组成部分,以伦纳、帕舒卡尼斯和柯林斯等人的研究为主要代表。他们通过对法律的经济根源、意识形态本质及其消亡的分析,创新性地解读了"经济决定论""阶级工具论"与"法律消亡论",对深化马克思主义法律思想研究具有一定的借鉴意义。国外马克思主义法律思想研究试图继承、坚持和发展马克思主义的基本立场和观点,但也存在一些对马克思主义的误读和曲解。当前学术研究不能盲目认同国外马克思主义法律思想研究,而需保持一种辩证态度与其进行积极对话。

The study of Marxist legal thoughts is a major component of today's overseas Marxist theory,with Renner, Pashukanis,and Collins as representative researchers.Through the analysis of economic origin of law,the essence of ideology and its extinction,these scholars innovatively interpret the theory of"economic determinism","classes as a tool",and "the extinction of law",which is beneficial and significant for the further study of Marxist legal thoughts.The theorists of overseas Marxist legal thoughts endeavor to carry forward,adhere to and develop the basic stands and views of Marxism,but they sometimes misunderstand Marxism.We should hold a dialectical attitude in order to communicate with overseas theorists, rather than uncritically accepting overseas Marxist legal thoughts.
