《国际商事仲裁示范法》的创设、影响及启示

Model Law on International Commercial Arbitration:Creation, Influence and Inspiration

联合国国际贸易法委员会《国际商事仲裁示范法》是国际商事仲裁领域举足轻重的"软法"。该示范法充分体现了仲裁的核心价值和制度设计,克服了国际公约在统一法方面的种种不足,契合了经济全球化的宏观背景。正因如此,该示范法取得了广泛的国际影响力,并对国际商事仲裁制度的统一作出了贡献。纵观"一带一路"建设主要沿线国家以及我国所处的亚太地区,《国际商事仲裁示范法》法域已然形成"包围"之势。欲实现我国仲裁制度的进一步国际化,可考虑在以下两方面进行完善:一方面,可以运用法律解释方法,将《国际商事仲裁示范法》的精髓有机融入到我国的司法实践中;另一方面,以《国际商事仲裁示范法》为蓝本,对我国《仲裁法》,尤其是涉外篇部分,进行符合仲裁国际性和一致性要求的法律修订。修订具体应考虑巩固仲裁核心原则、明确仲裁地的认定标准、认可外国仲裁机构和临时仲裁、进一步强化仲裁庭权限和司法支持。

UNCITRAL Model Law on International Commercial Arbitration is an influential"soft law" instrument. Model Law has fully reflected the core value and advanced system design of the international commercial arbitration, overcome the drawbacks of the convention in terms of law unification and fitted the macroeconomic background of globalization. These are the reasons why Model Law has achieved great success and made great contributions to the unification and harmonization of the arbitration system. Looking at the Belt and Road countries and the Asia-Pacific region, China has been surrounded by Model Law jurisdiction. In order to globalize our arbitration system, taking into account the experience of Model Law, the following approaches are suggested. On the one hand, in a short term, we could introduce the essence of Model Law into our judicial practice through internationalized domestic legal interpretation method. On the other hand, by referring to Model Law, we need to amend The P.R.C. Arbitration Law so as to reflect the international character and uniformity of the arbitration system. The P.R.C. Arbitration Law amendment shall further specify the core arbitration principles, the seat of arbitration standard, the recognition of foreign arbitration institutions and ad hoc arbitration, and enhance the arbitral tribunal authority and judicial support.
