摘要
无固定期限劳动合同,是用人单位与劳动者约定无确定终止时间的劳动合同。由于缺乏对无固定期限劳动合同制度的正确认识,不少人认为无固定期限劳动合同一经签订就不能解除。针对诸多误解,我们必须清晰把握无固定期限劳动合同的概念及价值,了解无固定期限劳动合同制度在我国的必要性,厘清我国无固定期限劳动合同的立法现状及现实困境,从"治标"和"治本"的两个角度,不断完善该制度。
Non-fi xed-term labor contract is a labor contract that signed by the employer and the employee who have agreed not to determine the termination time.Due to the lack of understanding of the non-fi xed-term labor contract system, many people believe that a fi xed-term labor contract cannot be cancelled once it has been signed.In response to many misunderstandings,we must clearly understand the concept and value of non-fi xed-term labor contracts,understand the necessity of non-fi xed-term labor contract system in China,clarify the legislative status and realistic dilemma of China's nonfi xed-term labor contracts,and improve the system from the perspective of application and institution.
