自媒体“技术赋权”背景下公民参与权的特点及法律保障

Characteristics and Legal Protection of Citizens’ Participation Right with the Background of "Technical Empowerment" of We-Media

公民社会参与及其相应的权利和义务是民主制度的重要构成。在当前自媒体非常发达的背景下,自媒体所拥有的强大技术和丰富资讯对使用者产生了一种“赋权”效应,即不仅扩大了公民参与的范围和广度,也提升了公民参与的层次。但这种“技术赋权”也产生了一定的负面效应,集中表现在参与权利资格与权利行为的矛盾和割裂。需要以宪法和法律为制度框架,对公民参与权的保障方式进行反思,在认可公民参与权民主价值的同时,对网络言论自由进行界定与规范;加强自媒体权力的引导,增加公民社会参与的方式和路径,实现公民参与权提升与网络环境净化的良性循环。

Citizens' social participation and their corresponding rights and obligations are important components of a democratic system.Under the background of We-media is very developed,the powerful technology and rich information of We-media have produced an "empowerment" effect on their users,that is,it not only expands the scope and breadth of citizen participation,but also promotes the level of citizen participation as well.However,this kind of "technological empowerment" has caused certain negative effects,which are mainly manifested in the contradiction and separation between the qualification of participation rights and the behavior of rights.These contradictions need to be reflected under the framework of the Constitution and law.While recognizing the democratic value of citizens' participation right,we should define and standardize the freedom of speech on the Internet and strengthen the guidance of We-media power,increasing the way of citizens' social participation and realizing the virtuous circle of promotion of citizens' participation right and the purification of network environment.
