摘要
罪犯在狱中参加劳动,应当给予报酬,是监狱行刑的重要环节和法治要求。在监狱执法实践中,罪犯劳动报酬在提取、发放、管理、使用等方面往往存在提取标准模糊、缺乏刚性,分配比例失衡、缺少系统,管理监督随意、缺于自律等现象,特别是罪犯劳动报酬使用范围在与刑释储备、财产性判项、狱内消费、家庭救济、社会关系修复等方面如何做好有效衔接应对,加快构建规范有序、透明高效、创新治理、政策驱动的运行机制,不仅是新时代新形势下监狱依法执法的内在需要,也是适应社会主要矛盾发生深刻变化、落实党的十九大报告“以良法促进发展、保障善治”,彰显社会公平正义的价值引领。
Prisoners who participate in labor should be paid, and it is an important part of prison execution and the rule of law. In the practice of law enforcement, there are some problems in the prisoners’ remuneration in withdrawing, distribution, management and using. It should make an effective way to deal with the relationship among the application scope of prisoners’ remuneration and release reservation, property judgment, prison consumption, family relief and social relationship repairing. Accelerating the construction of a standardized, transparent and efficient operational mechanism reflected the value of social fairness and justice, accorded with the profound changes in the main contradictions of the society, and implemented the needs of the report of the 19th National Congress of the Communist Party of China.
